Following the successful defense by Société Nautique De Genève in the 32nd America’s Cup, Ernesto Bertarelli's Alinghi team laid out a Protocol in July 2007 for the 33rd Match that found little support within the sailing community. The terms provided the defender with unprecentended rights, and Challenger Larry Ellison's BMW Oracle Racing team representing Golden Gate Yacht Club took the issue to the New York Supreme Court. Through a series of decisions by both teams, and by a number of findings by the court system, these two teams ultimately faced each other in a Deed of Gift Match.
