TruPlug Wins Lawsuit Against Forespar

Santa Clarita, CA (March 22, 2016) – The Orange County Superior Court has awarded TruPlug, manufacturer of the original TruPlug® emergency plug for boats, over $500,000 in damages in its lawsuit against Forespar, a marine products distributor in Rancho Santa Margarita, CA.

TruPlug sued Forespar, its distributor, when Forespar breached its exclusive distribution agreement and started selling its own emergency marine plug in lieu of TruPlug. The jury found that Forespar breached its contract; the unnamed jury rejected Forespar’s counterclaim against TruPlug, and released TruPlug from its exclusive distributor agreement with Forespar. With no inventory available, Forespar now has no ability to sell TruPlug’s patented products in the marketplace.

The TruPlug is a tapered circular cone-shaped plug made of foam that acts as a temporary or emergency plug to prevent water from entering a circular, oval, or irregular hole caused by emergency maintenance or hull breach.

“TruPlug will now be aggressively selling our proven, patented product directly to dealers,” said Henry Goldman, Chief Operating Officer of TruPlug. “Forespar’s statement of their replacement product for TruPlug is, and was, a misleading statement.”
