Getting sailors back on the water

Taran Teague, Chair of the US Sailing Race Management Committee, shares two sample Waiver Templates for sailing organizations to help get sailors back on the water amid the COVID-19 outbreak:


US Sailing has provided these sample Waiver and Release agreements as a resource for our member organizations. US Sailing makes no guarantees as to the legal sufficiency of the agreements and nothing contained therein shall be considered legal advice. You should contact your attorney to obtain advice with respect to any particular issue or problem.

The “Regatta Waiver and Release of Liability” is intended for use at competition events that are run under The Racing Rules of Sailing, Including US Sailing Prescriptions.

The “Non-­‐Regatta Waiver and Release of Liability” is intended for use at events that are not regattas or other competition events. This waiver should not be used for events that are run under The Racing Rules of Sailing, Including US Sailing Prescriptions.

Please be aware that RRS 82, a US Sailing Prescription, prohibits an organizing authority from requiring a competitor “to assume any liabilities of the organizing authority, race committee, protest committee, host club, sponsors, or any other organization or official involved with the event.” For further information, please go to rules.ussailing.org and click the “Indemnification” link.
