A Racing Rules Conundrum

There are two boats that have contact, and the mission is to determine fault. Ready? Here we go:

Both are on starboard with one boat on an upwind course and the other is on a downwind course. Okay, simple enough, the leeward boat must keep clear of the windward boat. But at the time of contact, they both look to be the leeward boat.
